General terms and conditions of sale

Article 1. Definition of student

The term "student" refers to the natural person to whom the training is provided. The full identity of the student is that indicated on the enrolment contract signed by both parties.

Article 2. Teaching

Teaching includes :

 

The provision of teaching aids in accordance with the program of study, automatically deposited in the student's space.

The work guidelines and advice required to ensure that the student's learning progresses smoothly.

The provision of assistance and pedagogical support throughout the training period (on-call duty, coaching and telephone appointments, messaging with trainers). The aim of this support is to receive and deal with any questions you may have about understanding the course. This presence is included in the Neurolink training curriculum and is designed to offer a high level of training quality and follow-up.

As an option, a remote or face-to-face coaching package is available for personalized support, both pedagogical and professional. The amount of each package will be determined according to each student's needs and project. All requests must be sent by e-mail or post to the Institute, to be studied by the trainers.

At the end of the course, the student will receive a certificate of completion, mentioning the dates and title of the course, in accordance with article L.335-15 of the French Education Code. 

This certificate is issued on condition that all modules have been completed and the full course fee paid. The certificate attests to the personal investment made by the student throughout the course and will enable him/her to make the most of his/her training as part of his/her career plan.

 

It is strictly forbidden to teach all or part of the Neurolink course content to anyone else, as it requires a high level of practical experience. 

If the training is financed by an organization, the student undertakes to :

- Completing the training in full and to the required standard.

- Return all signed documents sent by Neurolink Institute, i.e:

     1) The training program, sent after return of the signed contract.

     2) The training completion certificate.

Even if these conditions are not met, Neurolink Institute reserves the right to invoice the student for the entire training program.

In the event of payment pending final approval, the student undertakes to pay for the course in full. The student will be reimbursed once the course has been paid for by the funding organization.

Article 3. Access to training materials

Once the first payment has been received, the student has access to the online prerequisites.

Neurolink Institute will provide the student with all the teaching aids required to follow the training course in the best possible conditions.

The provision of the various teaching aids is subject to the student being up to date with his or her payments to Neurolink Institute, according to the payment schedule chosen by the student.

For better assimilation of knowledge, tutorials will be available on the student space after each training module, following registration.

The Neurolink Institute reserves the right to modify its study program and/or the order in which courses are delivered, in order to improve and update training content in line with the latest advances in knowledge and developments implemented by the Institute.

 

The distribution of course content to third parties or online, even partially, is strictly forbidden.

Article 4. Inter-module practice

During the time left free to the student between the 2 training modules, he/she is asked to practice on as many patients/clients as possible what he/she has learned during module 1. This enables them to improve their practice and be confronted with a wider range of cases. A minimum of 30 patients/clients per month will be required. The student is responsible for finding these patients/clients on his or her own.

Article 5. Registration formalities

Subject to validation by the pedagogical department, the contract will come into effect upon acceptance of the General Terms and Conditions of Sale, signature of the enrollment contract and payment of the deposit stipulated in this contract.

Minors are not authorized to register for this course.

Article 6. Course duration

The average duration of training is approximately 7 to 9 months, from the time of enrolment.

For reasons specific to the student, he or she may momentarily suspend his or her learning progress, allowing more time than the 3/4 months scheduled between the 2 modules. However, this break cannot exceed 1 year. 

This one-off interruption does not entail any postponement of the initial financing plan. All due dates must be paid, unless the school agrees otherwise. However, if the interruption is longer than 12 months, the institute may update the fees in line with changes in teaching content.

In the case of a suspension or interruption of 12 months or more, the school will consider the possibility of force majeure. A case of force majeure may be invoked in the event of long-term illness (on presentation of a medical certificate), death, etc. 

Article 7. Course price

The price of the training course is all-inclusive and includes all services provided by the Institute: access to teaching aids, certificates of attendance, responses to teaching queries sent to trainers by telephone, in writing or via the student area, and teaching assistance. 

The price is firm and non-revisable for the duration of the contract.

The cost of the full first-level training course is €4,400, as of January 1, 2023. Payment for the course is made according to the payment formula chosen by the student and indicated in our price list, i.e. in 1, 3 or 6 instalments. The payment schedule is set at the time of enrolment.

Students are not required to purchase any books or other documents. Our courses are complete and do not require any additional teaching material. In fact, we strongly recommend that you do not interfere with the quality of the teaching content by using materials other than those provided by the Institute.

Article 8. Payment terms

Payment terms are clearly indicated on the registration contract. In the event of non-payment of the deposit on receipt of the present contract, and whatever the method of payment chosen, the student authorizes Neurolink Institute to make a SEPA direct debit including the deposit with the other monthly payments.

The price of the training course is indicated in Euros (€) and is not subject to VAT in the offer accessible via the Neurolink Institute website. The balance of the price is payable in a single instalment or, after deposit, in monthly instalments (payment in 3 or 6 instalments), according to the terms indicated in the Special Conditions and chosen by the student at the time of subscription. If direct debit is chosen as the method of payment, the student will give a SEPA direct debit mandate to his/her bank.

In the event of difficulty, the student may contact the Neurolink team to discuss a new payment schedule, subject to the Institute's agreement.

Article 9. Financial terms and conditions

Modifications :

The student may, in exceptional circumstances and subject to the Institute's agreement, change payment formulas during the course of training (accelerate or extend monthly instalments).

Fees:

In the event of non-payment or rejection, bank charges will be automatically applied.

Late payment :

In the event of a payment incident (direct debit rejection, unpaid cheque, refused credit card, late payment, etc.), the student will be asked to regularize the situation, failing which he/she will not be able to continue the course. Payment of sums due may be made by any means (cheque, bank transfer, credit card, cash), for regularization.

Article 10 Interruption of payments and suspension of training

In the event of interruption or suspension of payments, access to the student area will be blocked by Neurolink Institute. In the event of interruption of payment, the debt collection department will be contacted to take all necessary measures to ensure that the payment schedule initially agreed in the contract is respected.

Article 11. Postponement of training

In the event of unforeseen circumstances or force majeure, the student will have the option of postponing the course for which payment has already been made or paid in full.

The Neurolink Institute reserves the right to postpone training dates if teaching conditions are not optimal (insufficient number of students), or in the event of force majeure (transport strike, bad weather, illness, etc.).

Article 12. Legal withdrawal period

The student has a period of 14 days to exercise his/her right of withdrawal without having to justify his/her reasons or pay any penalties.

This period expires 14 days after the date on which the student signs the enrolment contract.

Payments already received will be reimbursed by bank transfer or cheque.

Students wishing to exercise their right of withdrawal must send a letter of withdrawal, by registered mail with acknowledgement of receipt, to the following address

Article 13. Termination of the contract

The present contract may be terminated by the student within the first 3 months of its coming into force. Article 27 of decree no. 72-1218 of December 22 1978 stipulates that the student must send his/her cancellation by registered letter with acknowledgement of receipt to Neurolink, 1, av du Maréchal Leclerc - 13220 Châteauneuf-Les-Martigues - France, under the conditions set out in the French Education Code, of which the last paragraph of article L.444-8 is reproduced below: "Under penalty of nullity, the contract cannot be signed until seven days after its receipt.

The contract may be terminated by the student or his/her legal representative if, as a result of a fortuitous event or force majeure, he/she is prevented from attending the corresponding course. In this case, no compensation is due.

Until the expiry of a period of three months from the date of entry into force of the contract, it may be unilaterally terminated by the student in return for compensation not exceeding 30% of the contract price, excluding supplies.

Amounts already paid may be withheld accordingly.

Course materials, objects or equipment provided for in the contract and actually delivered to the student on the date of termination are retained for the value estimated in the contract. This value may not exceed 30% of the total cost of the course.

No more than 30% of the agreed price, excluding supplies, may be paid in advance. For courses whose total duration exceeds twelve months, the 30% is calculated on the price of the first pedagogical year as set out in the study plan.

Any course sent by e-mail or deposited on the student space will be taken into account in the calculation of the cancellation.

The contract must reproduce the provisions of the present article, failing which it will be null and void. It may not include any jurisdiction clause".

Termination after 3 months: the student must honor the contract and pay the instalments initially scheduled.

Article 14. Intellectual property rights

The content of the website is the property of Neurolink and its partners. It is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

In addition, the Neurolink Institute remains the owner, or duly the only one authorized, to exploit the intellectual and industrial property rights attached to the studies, drawings, models, prototypes, media and any element protected in this respect, produced (even at the student's request) with a view to providing training to the student.

The student therefore refrains from reproducing or exploiting said studies, drawings, models, supports, prototypes, and any elements protected in this respect, without the express, written and prior authorization of the Neurolink Institute, which may require financial compensation.

In addition, Neurolink Institute remains the exclusive owner of all elements supplied during the training course, or the only one duly authorized to use these elements within the framework of the training courses it provides. The student has an exclusively personal right to use any medium (electronic, computer, paper, audiovisual, multimedia, etc.) and any teaching provided. The student may use the knowledge acquired to apply it for any personal or professional purpose. However, they are prohibited from reproducing, representing, copying, adapting or paraphrasing and generally exploiting the teaching provided with a view to communicating it to a third party, whether in return for payment or free of charge.

The student undertakes to indemnify the Neurolink Institute against any third party in the event of violation of the provisions of the present article, including the assumption of responsibility for any condemnation, indemnity, legal and procedural costs incurred as a result of the student's fault.

Article 15.  Image rights - Videoconference recording

During training, photos, videos and videoconferences may be taken and recorded for teaching, marketing and commercial purposes.

Recordings are accessible to Neurolink Institute staff in charge of processing them and, where they are of educational interest (e.g. virtual classes), to students enrolled in the corresponding course.

They are kept by the Neurolink Institute, which may use them for its own communication purposes, for an indefinite period. Unless expressly agreed by the persons concerned, they will not be passed on to third parties.

 

The recording and broadcasting of a videoconference and its content (present on the course materials) by a student, even partially, whatever the process used (taking videos, photos, screen captures, etc.) is strictly forbidden.

 

When subscribing to the contract, the student confirms that he/she is aware of the provisions of the present article and gives his/her consent to the Institut Neurolink to use the recordings (video, photos, videos) within the framework of the conditions described above.

Article 16. Student behavior and compliance with internal regulations

The student undertakes to comply with the Institut Neurolink's internal rules and regulations, and to behave in a diligent and respectful manner.

Article 17. Customer service

The Institut Neurolink also provides the student with its customer service department, which is available to answer any questions concerning the proper reception of courses, the organization of videoconferences, the assistance support of the online platform, the payment of monthly instalments, etc. It can be reached by e-mail (via the platform) or by telephone on 06.14.76.14.01.

Article 18. Transmission of the Contract

Under no circumstances may the Contract be transmitted - whether in return for payment or free of charge - by the student to a third party without the express prior written consent of the Institut Neurolink. The Institut Neurolink may transmit the Contract to any third party subject to the strict condition that the content of the training, the teaching team and the teaching aids are not modified and, more generally, that the student's rights as set out in the Contract or in the law are not modified.

Article 19. Acceptance of the General Terms and Conditions of Sale

The present general terms and conditions of sale are expressly approved and accepted by the student, who declares and acknowledges full knowledge thereof.

Article 20. Applicable law and language

By express agreement between the parties, the present contract is subject to French law.

It is written in French. Should it be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.

Article 21. Mediation in the event of a dispute

Any beneficiary having a dispute with Institut Neurolink is invited to inform the creators (Olivier Carpentieri and Ingrid Atamian). Should it prove impossible to reach an agreement, the beneficiary may refer the matter to a mediation organization.

The Contract is governed by French law.

In accordance with Article L612-1 of the French Consumer Code, you may have free recourse to the mediation service for the area of competence corresponding to the services offered by Institut Neurolink.

 

Failing mediation and amicable resolution of the dispute, any dispute will fall within the jurisdiction of the materially and territorially competent Court.
